The ACERTUS Terms and Conditions
To ensure a smooth shipment, please read and sign that you agree to the following terms:
- The estimated price is based on the information entered. Any modifications to your shipment details may change the price. Additional reasons that may change the price include:
- If any vehicle(s) is inoperable at the time of pick up, ACERTUS may refuse pick-up, or upon delivery, may charge an additional “inoperable fee” per inoperable vehicle. The fee will vary based on the circumstances causing the inoperability and ACERTUS will notify you how much the fee is at the time of pick-up for your agreement.
- If there are additions on the vehicle (i.e. camper, roll bars, lift kit, raised roof van, etc.) at pick-up which ACERTUS was not notified to in writing, ACERTUS may refuse pick-up with or charge an additional fee based on the type of additions.
- Pickup will not be scheduled until payment in full has been made.
- For any “dry-run” requested or ordered by a Customer a fee of $100 will be charged.
- If you cancel your shipment before a transportation carrier is secured, there is no cancellation fee. If you cancel your shipment after a transportation carrier is in route, you may incur up to a $100 cancellation fee. You may cancel the order by calling an ACERTUS representative at the phone number found on your order confirmation email.
- You are the registered legal owner of the vehicle(s), or are authorized by the legal owner to enter into an agreement for transportation of the automobiles.
- ACERTUS may subcontract its obligations to transportation carriers.
- All pickup and delivery dates and times are estimates only. ACERTUS agrees to make every reasonable effort to complete timely vehicle transport pickup and delivery, however, ACERTUS cannot guarantee specific dates or times. ACERTUS or its transportation carriers are not responsible or liable for any claim or loss in the event ACERTUS or its carriers are late in picking up or delivering your vehicle(s), regardless of the length of the delay. This includes no reimbursement for car rental fees, storage fees and depreciated value resulting from delay, damage or accident.
- Upon pickup you or the Vehicle Owner must inspect the entire vehicle with the driver and fill out a vehicle condition report prior to transportation. This is critical to ensuring that all current damages are noted, authorized and agreed upon prior to the vehicle leaving your possession. Taking photos and videos of your vehicle along with a copy or photo of the condition report is strongly recommended.
- At the time of delivery you or the Vehicle Owner must identify any damage to any vehicle(s) with the driver by noting the damage on the Bill of Lading. Any claims related to damage must be submitted to ACERTUS within 48 hours of the date that vehicle(s) were delivered. You waive any damage claims that are not noted on the Bill of Lading or have not submitted a timely claim. ACERTUS will be liable if it is determined damages occurred while the vehicle(s) were in the care, custody, and/or control of ACERTUS or ACERTUS’s subcontractors.
The following terms govern the process and procedures are required to submit and resolve claims for damage to a Vehicle that occurs during the course of ACERTUS or a Carrier providing the Services:
- You or the Vehicle Owner shall inspect each Vehicle immediately prior to pick up and/or delivery of unit and report to ACERTUS, within 48 hours.
- Upon receiving the vehicle, you or the Vehicle Owner shall do a thorough inspection to ensure that there is no damage to vehicle(s).
- You or the Vehicle Owner must notate damage on the Bill of Lading (BOL) or Electronic Condition Report before signing. Once a BOL is signed, ACERTUS and the Transport driver are released of liability for damages not notated and any damage claims are hereby waived.

- Upon receiving notice, ACERTUS shall handle damage claims or losses that was assigned to ACERTUS.
- The ACERTUS claims department will begin investigating the claim once all required paperwork noted above (a, b and c) is received and will use best efforts to resolve claims within twenty (20) days of the date all required paper-work is received, unless it is classified as a major damage claim (resulting in repairs of more than $1,500) in which case, resolution may take longer than twenty (20) days
- Please remove all detachable personal/household belongings from the vehicle(s). ACERTUS or its transportation drivers cannot take responsibility for the safe transport, loss, or damage of your personal items and household goods left in car. ACERTUS and its drivers may refuse to move your car until all such items are removed.
- Door-to-door pickup and delivery may be relocated to a nearby location. In the unlikely event the driver cannot deliver the vehicle(s) due to natural (low hanging trees, etc.) or man-made (dead end streets, cul-de-sac’s, narrow streets, low clearance, bridges, crosswalks, street closing, construction, etc.) obstructions, you and the driver will meet at an agreed upon location to take possession of your vehicle.
- These policies and agreements supersede all written or oral agreements between ACERTUS and may not be changed except when in writing by ACERTUS. This Agreement shall be governed by and interpreted in accordance with the laws of the state of Missouri. Any legal action arising out of this agreement shall be filed in a court of competent jurisdiction within St. Louis County, Missouri. In any action, suit, arbitration or proceeding brought by either party, the prevailing party should be entitled to recover its reasonable attorneys’ fees and costs in each and every such action, suit, arbitration or other proceeding.
